Supreme Court upholds building license of Land Trades’ ‘Solitaire’

Mangaluru: The Supreme Court recently upheld the building license given to Land Trades Builders & Developers’ residential project ‘Solitaire’ by the Mangaluru City Corporation (MCC).

It can be recalled that some residents of the locality, who were aggrieved by the MCC’s proposal to widen one of the approach roads to Solitaire, had approached the High Court with a Public Interest Litigation (PIL) challenging the building license.

After listening to the arguments of all the parties concerned, the High Court had upheld the building license given to Solitaire as legitimate and concurred with the MCC’s decision to give the license. The petitioners then appealed the High Court order before the Supreme Court.

Now in its order dated July 19, 2019, the Supreme Court too dismissed the PIL and upheld the legality of the license. The Supreme Court has also directed the MCC to issue a Completion Certificate for Solitaire expeditiously in accordance with the law.

In the same order, the Court has also vacated its status quo on the widening of the approach road to Solitaire. Accepting the advice of the Judges to address the grievances of the petitioners, the MCC has undertaken before the Court vide written affidavit to construct a retention wall to protect the structures of the concerned petitioners at the time of road widening in the future. With this, all the legal hurdles with regard to the road widening have been overcome.

“Solitaire is a prestigious project where we have tried to set a new benchmark for excellence. The litigation regarding this project was pending before the courts for a long time. Now we are glad that our building license has been legally validated by the highest court in the land,” said K Shrinath Hebbar, proprietor of Land Trades.

“I am grateful to our customers and associates who have reposed their complete faith in me during this period,” he added.
