HC’s Kalaburagi Bench orders cop to clean road not registering FIR in kidnapping case

Kalaburagi: A Station House Officer (SHO) was recently directed by the Kalaburgi Bench of the Karnataka High Court to clean the road in front of the police station, where he is in charge, for one week.

According to a report by India Today, the SHO is attached to the Bazar Police station in Kalaburagi. The HC issued the order on December 17 for the officer to do this community service as punishment for failing to register an FIR with regard to a kidnapping complaint.

The HC issued the order based on a habeas corpus petition moved by plaintiff Tarabai, who stated that her son, Suresh went missing on October 20.

“The entire development in the case after Suresh going missing discloses to us a very disturbing facet of the functioning of the police stations in this area. The problem, primarily, is one of the police officers not complying with the procedure prescribed under the Code of Criminal Procedure, which places a high premium on the guarantee of liberty of the individuals,” the order said, as per reports.

While giving the order, the HC noted that the SHO had admitted that the petitioner had approached him with a grievance that her son had been kidnapped and that he was not found.

The district superintendent of police was also directed by the HC to hold workshops/orientation courses for all police officers in the Kalaburagi District on the subject “zero FIR”.

Meanwhile, commenting on the development, Kalaburgi City Police Commissioner Satish said that they will file an appeal on the order as they feel that there were no lapses on their side.
