New Delhi/Bengaluru: The hearing into the disqualification of 17 Karnataka legislators will be taken up by the Supreme Court on Wednesday. Though it was initially said that the case would come up for hearing before the Apex Court on Tuesday, the date has been postponed.
A Three-member divisional bench headed by Justice NV Ramana will hear the case. The hearing is expected to touch upon the aspects of Operation Kamala, the resignation of the sitting MLAs, disqualification, the powers of the Speaker and the rights of the disqualified MLAs in terms of contesting polls. The hearing gains all the more important because the Election Commission has already announced the dates for the bypolls for 15 constituencies that were represented by the disqualified MLAs.
While the Election Commission urged the Apex Court to take up the hearing at the earliest, Congress leader and advocate Kapil Sibal moved the Court seeking postponement into the hearing of the case. However, with the long-drawn Ayodhya case coming up for hearing around the same time, the Court decided to delay the hearing into this case.
The disqualified MLAs have urged the court to scrap off the decision of the Speaker to disqualify them and grant them permission to contest in the by-polls
