Rohini can continue as Hassan Deputy Commissioner for now: HC

Hassan/Bengaluru: The High Court of Karnataka on Tuesday ordered that Hassan Deputy Commissioner Rohini Sindhuri Dasari continue in the same post till the Central Administrative Tribunal (CAT) adjudicates afresh her plea against the transfer. She questioned the legality of the government’s action of transferring her.

A Division Bench comprising Chief Justice Dinesh Maheshwari and Justice B.M. Shyam Prasad passed the order while setting aside the March 21 order of the CAT, which had disposed of the plea against transfer by directing Ms. Rohini to submit a representation to the Chief Secretary (CS) by March 26 elaborating her grievances against the transfer. The CAT had also asked the CS to take a decision on the representation within three days of receipt of letter.

Rohini, instead of submitting representation to the Chief Secretary as per CAT’s direction, had moved the High Court by contending that the tribunal had not given any judicial finding on her petition against the transfer.

She had challenged her transfer from the post of Hassan Deputy Commissioner on the grounds that it was a premature transfer as she was eligible to continue in the present post for two years as per the rules governing the Indian Administrative Service. She also alleged that her transfer was owing to “political pressure” by local politicians on the Chief Minister as she had cracked down on the mining mafia in the district.
