Shut potholes in 3 days or face action: HC to BBMP

Bengaluru: The High Court of Karnataka has stringently warned the Bruhat Bengaluru Mahangara Palike (BBMP) for its lackadaisical attitude in maintaining the city roads and ordered the shutting of potholes in three days starting today, in a verdict on Thursday, September 20.

During the hearing it said, “By the 24th of this month, all the potholes under BBMP jurisdiction must be closed and none must be seen.”

The order was given based on a PIL (Public Interest Litigation) submitted by the Koramangala residents Vijayan Menon and four others on the issue. “The potholes have been causing deaths and misery among the people in the city”, a divisional bench comprising Chief Justice Dinesh Maheshwari and Justice S G Pandit opined.

The court has warned BBMP in its hearing saying, “If the orders of the court are not taken into consideration responsibly, then be ready to face the consequences.”

Advocate for BBMP V Shreenidhi said, “After the courts’ direction yesterday, around 899 potholes have been closed.”

Advocate for PIL applicants, S R Anuradha said, “If required I’m ready to inspect the work with the engineers. I’m ready to go for spot inspection right now.”

Objecting the statements of Anuradha, Sreenidhi said, “What does she think about herself? I have proof regarding the completed work. I can produce the pen drive right away. Let her check the reports regarding the completed work.”

C J Dinesh Maheshwari intervened and said, “The advocate for PIL applicants has absolute right to present her opinion. It is your duty now to remind the engineers of their responsibilities and allay suspicions.”

“Alas! you completed the work. Good for you. You have not become a hero after the pothole patch up. Your clients have not accomplished something very great”, he remarked sarcastically.

C J Maheshwari said, “There are other issues excluding the pothole issue. It is very sad and unfortunate that a PIL has to be filed to alarm BBMP to complete the civil works and make it aware of its responsibility. The purpose of BBMP is to accept complaints on civic matters and resolve them.”

He also further commented on the issue saying, “Patchwork is not the end of it. Your engineers must know their responsibilities. It is not enough to just patch up the roads. The court does not accept such a work. There should be a permanent solution with best quality output.”

“The roads have to be constructed in such a way that there should be no more potholes in the city”, he added.

He advised, “Ensure that no more PILs are filed. If filed, BBMP has to come with proof that it has completed the work. The working style should be such.”

The court is adjourned till September 24.
