HC to Schools: Implement the guidelines in phases

Bangalore: The Karnataka High court advised the police not to file charge sheets against schools for failure to implement the recently issued safety guidelines, instead, Justice A N Venugopala Gowda on Wednesday asked to instead go for a peaceful approach.

During the hearing of a petition of the Karnataka Private Schools Joint Action Committee (KPSJAC), challenging the guidelines issued by the police department in July for the safety of schoolchildren, the state on Tuesday submitted that it has taken action against 186 schools for not implementing these guidelines.

Justice Gowda was of the opinion that the police should have given time to the schools or issued guidelines with phase-wise implementation. “However, the police acted in haste and exercised their authority. The registration of cases was not called for,” he observed.

The court has now directed the nodal officer appointed by the police to conduct zone-wise meetings with the schools.

However, the court said that in case the schools persistently fail to implement the guidelines, the police can proceed against them.

Deadline Extended

The High Court hearing the petition of the school managements did not relax the guidelines but extended the deadline and asked the institutions to implement them in phases.

The government institutions got two months, while the private institutions got one month.  The Additional Advocate general appeared for government schools and was admonished by the court for citing difficulties with the two sets of guidelines. The court refused to entertain any excuses. “If you don’t implement, how can you ask the private institutions to implement the same? Practice before you preach,” it observed.

The court directed the private institutions to get to work immediately.
